Welcome to Honorable Mention. Throughout these Terms of Service, the terms “Honorable Mention,” “we,” “us,” and “our” refer to Honorable Mention and its affiliated services, website, products, and operations.
By accessing, browsing, purchasing from, or otherwise using this website or any related services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service, along with all related policies, notices, disclaimers, and conditions referenced on this website. If you do not agree to these Terms, you must discontinue use of the website and services immediately.
These Terms apply to all visitors, customers, users, browsers, and purchasers of products or services from Honorable Mention.
1. Product Use & Customer Responsibility
All products sold by Honorable Mention are purchased and used entirely at the customer’s own discretion and risk.
Fragrance products are intended for external cosmetic use only. Customers are solely responsible for reviewing product descriptions, ingredient information, usage recommendations, safety information, and all related policies prior to purchase and use.
Honorable Mention shall not be held liable for:
• Allergic reactions
• Skin irritation or sensitivities
• Misuse of products
• Improper storage or handling
• Damages caused by spills, staining, leakage, or breakage
• Individual dissatisfaction related to scent preference or performance
• Indirect, incidental, punitive, or consequential damages arising from product use
Customers are encouraged to perform a patch test prior to full use, especially if they have sensitive skin, allergies, asthma, or known sensitivities to fragrance ingredients.
2. Orders & Acceptance
All orders placed through Honorable Mention are subject to acceptance and availability. We reserve the right to refuse, limit, cancel, or modify any order at our sole discretion and without obligation to provide explanation.
Orders may be canceled due to suspected fraud, billing inaccuracies, inventory errors, suspected resale activity, policy violations, pricing issues, shipping concerns, or any other reason deemed necessary by Honorable Mention.
Once an order has been placed and processed, cancellations or modifications may not be possible.
Customers are responsible for ensuring all billing, shipping, and contact information provided at checkout is accurate and complete.
3. Pricing & Availability
All prices, promotions, product availability, packaging, descriptions, and formulations are subject to change at any time without prior notice.
Honorable Mention reserves the right to correct typographical errors, pricing errors, inventory inaccuracies, or omissions at any time, including after an order has been submitted.
We do our best to maintain product consistency; however, handcrafted and small-batch fragrance products may naturally vary slightly in color, maturation, projection, labeling placement, packaging, or scent evolution.
4. Shipping, Delivery & Customs
Honorable Mention’s primary domestic shipping carrier is USPS. International orders are primarily shipped through UPS or other selected carriers depending on destination and service availability.
We do our best to keep shipping costs as affordable as possible while ensuring products are packaged and shipped with care.
Shipping timelines are estimates only and are not guaranteed. Honorable Mention is not responsible for delays caused by shipping carriers, customs processing, weather conditions, labor disruptions, incorrect addresses, international import restrictions, or circumstances outside of our control.
International customers are solely responsible for any customs duties, import taxes, clearance fees, brokerage fees, or additional charges imposed by their destination country.
If customs fees are refused or delivery is declined, the package may be returned, abandoned, or destroyed by customs authorities. Honorable Mention is not responsible for such outcomes, and refunds will not be issued.
Risk of loss transfers to the customer once the shipment has been transferred to the shipping carrier.
5. Lost, Stolen & Delivered Packages
Once a shipment has been transferred to the carrier and tracking confirms delivery, Honorable Mention is not responsible for lost, stolen, delayed, missing, misdelivered, or tampered packages.
Customers are responsible for ensuring the delivery address entered at checkout is secure and accurate.
Customers are encouraged to contact the shipping carrier directly regarding delivery disputes or claims once a package has been marked delivered.
6. No Return & No Refund Policy
Due to the personal-use and sanitary nature of fragrance products, all sales are final.
Honorable Mention does not accept returns, exchanges, cancellations, or refunds for fragrance products unless otherwise required by applicable law.
Fragrance perception is subjective and may vary based on personal preference, body chemistry, environment, application, storage conditions, and expectations. Dissatisfaction related to scent preference or fragrance performance does not qualify for refunds or returns.
7. Atomizer Issues, Damaged Orders & Defective Claims
If a customer receives a damaged, leaking, incorrect, or defective product, Honorable Mention must be contacted within 48 hours of confirmed delivery.
Claims submitted without sufficient documentation may be denied.
Customers must provide:
• Order number
• Clear photographs of the product and packaging
• Video proof of atomizer malfunction or defect
• Additional documentation if requested
Honorable Mention reserves the right to require return of the defective product before any replacement, store credit, or resolution is issued unless otherwise stated.
Honorable Mention retains sole discretion in determining whether a claim qualifies for replacement, partial accommodation, or denial.
8. Chargebacks & Payment Disputes
Customers agree to contact Honorable Mention directly regarding any order concerns before initiating a chargeback or payment dispute.
Fraudulent chargebacks, false claims, unauthorized dispute abuse, or attempts to retain products while reversing payment may result in denial of future purchases, collection efforts, reporting to relevant financial institutions, or legal action where permitted by law.
Honorable Mention reserves the right to submit order records, tracking information, delivery confirmation, customer communication, photos, videos, and supporting documentation in response to payment disputes.
9. Product Variations & Batch Differences
Honorable Mention fragrances are produced in small batches using fragrance raw materials that may naturally vary over time.
Slight differences in color, maturation, projection, packaging appearance, labeling placement, sediment, or scent evolution may occur and do not constitute defects.
Website images are intended for illustrative purposes only. Actual product appearance, bottle details, caps, sprayers, labels, or packaging materials may vary slightly based on supplier availability or production updates.
10. Product Misuse
Honorable Mention is not responsible for damages, injury, reactions, or losses resulting from misuse of products, including but not limited to ingestion, improper storage, transferring fragrances into unauthorized containers, exposure to heat, flame, sunlight, use near eyes or sensitive areas, or use inconsistent with intended cosmetic application.
Products should be kept away from children, pets, flames, excessive heat, and delicate surfaces or fabrics.
11. No Medical Claims
Honorable Mention products are cosmetic products only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Statements made on this website, social media, advertisements, packaging, or customer communications have not been evaluated by the Food and Drug Administration unless otherwise stated.
12. Intellectual Property
All website content, branding, logos, product names, graphics, photography, designs, text, videos, descriptions, packaging concepts, marketing materials, and visual assets are the intellectual property of Honorable Mention and may not be copied, reproduced, distributed, modified, republished, or used without prior written permission.
Unauthorized use of Honorable Mention intellectual property may result in legal action.
13. User Conduct
Customers may not use this website or services for unlawful purposes, fraudulent activity, harassment, abuse, unauthorized resale, data scraping, interference with website functionality, or violations of intellectual property rights.
Honorable Mention reserves the right to terminate or restrict access to the website or services at any time and without notice for violations of these Terms.
14. Resale & Redistribution
Products purchased from Honorable Mention are intended primarily for personal use and enjoyment. Customers may gift, trade, exchange, or resell personally owned bottles at their own discretion after purchase.
However, unauthorized commercial resale activity, bulk purchasing intended for large-scale redistribution, or purchasing inventory for the purpose of exploiting limited releases, artificially inflating pricing, or misrepresenting affiliation with Honorable Mention is strictly prohibited.
Customers may not represent themselves as Honorable Mention, an authorized retailer, distributor, partner, affiliate, or official representative of the brand without prior written authorization.
Honorable Mention reserves the right, at its sole discretion, to limit quantities, refuse service, cancel orders, or restrict future purchases if we suspect an order is being placed for unauthorized resale operations, inventory hoarding, fraudulent activity, or conduct that may negatively impact product availability, customer experience, or the integrity of the brand.
15. Social Media & Customer Content
By tagging, mentioning, submitting, or sharing content related to Honorable Mention on social media, reviews, messages, or other platforms, you grant Honorable Mention a royalty-free right to repost, share, display, reproduce, and use such content for marketing, promotional, or business purposes unless otherwise prohibited by law.
16. Refusal of Service
Honorable Mention reserves the right to refuse service, cancel orders, limit quantities, restrict access, terminate accounts, or deny future purchases at our sole discretion and without obligation to provide explanation.
17. Force Majeure
Honorable Mention shall not be liable for delays, interruptions, or failure to perform resulting from events outside of our reasonable control, including but not limited to natural disasters, weather events, labor shortages, strikes, supplier disruptions, shipping carrier interruptions, customs delays, internet outages, pandemics, governmental actions, or force majeure events.
18. Disclaimer of Warranties
All products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, accuracy, compatibility, or non-infringement.
Honorable Mention does not guarantee uninterrupted website access, error-free operation, or guaranteed product performance expectations.
19. Limitation of Liability
To the fullest extent permitted by law, Honorable Mention and its owners, affiliates, employees, contractors, service providers, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from:
• Use or misuse of products
• Delayed shipments or failed deliveries
• Website interruptions or technical issues
• Allergic reactions or sensitivities
• Loss of data or profits
• Third-party carrier issues
• Customs actions or import restrictions
• Product expectations or scent interpretation
Any liability arising from the purchase or use of Honorable Mention products or services shall not exceed the total amount paid by the customer for the specific order giving rise to the claim.
20. Indemnification
By using this website and purchasing from Honorable Mention, you agree to indemnify, defend, and hold harmless Honorable Mention and its owners, affiliates, employees, contractors, service providers, and partners from any claims, damages, liabilities, costs, expenses, or legal fees arising from:
